Background
Draft Scottish Statutory Instrument - The Public Services Reform (Insolvency) (Scotland) Order 2016
This Order is made under section 17 of the Public Sector Reform (Scotland) Act 2010. It amends the Insolvency Act 1986 (“the Act”) and the Small Business Enterprise and Employment Act 2015 (“the 2015 Act”). Article 2 comes into force on 1st April 2016, as do the other amendments to allow subordinate legislation to be made, including corporate Insolvency Rules under section 411 of the Act. The rest of the amendments come fully into force on 1st October 2016.
Timetable
The proposed Order was laid on 30 September 2015, and the Committee launched its consultation period on 2 October 2015.
Stakeholders were asked to share their views on the Order with the Committee, with a deadline of 13 November 2015. The below submissions were received and were shared with the Scottish Government.
