Consultation on the Code of Practice for Ministerial Appointments

The Public Appointments Commissioner issued a consultation on 30 August 2012 on possible revisions to the Code of Practice for Ministerial Appointments to Public Bodies in Scotland, this includes succession planning and reappointments.

The Standards, Procedures and Public Appointments Committee is required to consider and report on the consultation.

The Committee took evidence from the Commissioner on 25 October 2012.

The Committee intends to submit a report to Parliament in November 2013.

Succession planning and reappointments

On 22 March 2012, the Public Appointments Commissioner laid before the Parliament a report on succession planning and reappointments (272KB pdf).

To enable it to consider the matters discussed in the report, the Committee took oral evidence from the Commissioner and from Scottish Government officials at its meeting on 24 April 2012. The Committee also took the opportunity in this evidence session to seek comments on the implementation of the revised Code of Practice for Ministerial Appointments and the Commissioner’s equal opportunities strategy.

Following the 24 April meeting, the Committee wrote to the Commissioner to ask for more information about the role of and training received by the Assessors who are involved in each public appointment within the Commissioner’s remit.

On 31 May 2012, the Commissioner laid a second report before the Parliament in relation to succession planning and reappointments (43KB pdf).

The Committee has agreed that it will return to the matter of succession planning once the revised Code of Practice (which came into effect in September 2011) has been in operation for at least a year.

Commission for Ethical Standards in Public Life in Scotland

The Committee received a letter from the Presiding Officer, as Chair of the Scottish Parliamentary Corporate Body, in relation to a proposal from the Commission for Ethical Standards in Public Life in Scotland that the roles of the Public Appointments Commission and Public Standards Commissioner should be merged from May 2012.

The Committee considered the proposal at its meeting on 13 December 2011 after which it confirmed to the Presiding Officer that it did not object to the proposal in principle but that it wished to seek assurances that the functions of each office would be adequately fulfilled by a single commissioner.
