On 25 June 2008 I received from the BBC (a broadcasting corporation of PO Box 480, Manchester, M14 0EL) a fee of £222 for appearing as a panellist on a BBC political radio programme on 20 June 2008. This remuneration therefore falls within the ‘up to £500’ per annum bandwidth. [Registered 4 July 2008]

I participated in a survey for ComRes (a market research company of Morrison Street, Edinburgh). A cheque for £50 from ComRes made payable to the Paisley North Constituency Office was received during the week beginning 10 July 2009. This remuneration therefore falls into the ‘up to £500’ bandwidth. [Registered 7 August 2009]

I made a presentation at an Edinburgh conference organised by GovNet Communications (a leading public sector publisher and events organiser of Golden Cross House, 8 Duncannon Street, London WC2 4JF). A cheque for £100 from GovNet Communications made payable to Paisley North Constituency Office was presented on 14 July 2009. This remuneration therefore into the ‘up to £500’ bandwidth. I participated in a survey for Ipsos MORI Scotland (a research company of Wemyss Place, Edinburgh). A cheque for £75 from Ipsos MORI made payable to the Paisley North Constituency Office was received on 7 December 2009. This remuneration therefore falls into the ‘up to £500’ bandwidth. Between September and December 2007 I received two donations from Phoenix Car Company of Phoenix Retail Park, Linwood Road, Paisley, PA1 2BH. The first donation of £300 was registered voluntarily on 21 December 2007 and was received by me for the purposes of supporting my annual Paisley North Christmas Calendar. A second entirely separate donation of £995 was made directly to the leadership election campaign fund. On 8 December 2008 I received a further donation of £350 for the purpose of supporting my annual Paisley North Christmas calendar. In November 2009 I received a donation of £400 for assistance in the production and posting of my 2010 Paisley North Christmas Calendar. The total monetary value of the donations from Phoenix Car Company is therefore between £2,001 and £3,000. In December 2007 I received a donation of £500, voluntarily registered on 21 December 2007, from Chivas Brothers Limited (whisky manufacturers of 111-113 Renfrew Road, Paisley, PA3 4DY) for the purposes of supporting my annual Paisley North Christmas Calendar. In December 2008 I received a further donation of £350 for the 2009 version of the calendar. In November 2009 I received a donation of £400 for assistance in the production and posting of my 2010 Paisley North Christmas Calendar. In December 2008 I received a further donation of £300 for the 2009 version of the calendar. In November 2009 I received a donation of £300 for assistance in the production and posting of my 2010 Paisley North Christmas Calendar. In December 2008 I received a donation of £300 from MEPC Hillington Park (majority owner, landlord and management service provider of Hillington Park business and industrial estate; management office at The Hub, 3 Earl Haig Road, Hillington Park, Glasgow G52 4JU) towards the production and posting of my 2009 Paisley North Christmas Calendar, which was registered voluntarily on 15 December 2008. A donation of £400 was received in November 2009 for assistance in the production and posting of my 2010 Paisley North Christmas Calendar. During my campaign for the leadership of the Scottish Labour Party, my campaign received a number of donations, ten of which were for amounts over £520. All cheques were banked between 31 August and 5 November 2007. On 8 November 2007 the day following my campaign team’s submission of a voluntary return to the Electoral Commission, I sought written advice from the Clerk to the Standards, Procedures and Public Appointments Committee on possible Register of Interest reporting requirements. I was advised in writing that these did not require to be registered. Although I am satisfied that these donations do not prejudice my ability to participate in proceedings in Parliament in a disinterested manner, I obtained, in the interests of transparency, the consent of the donors to make a voluntary entry.

Subsequently, following the determination of the Standards, Procedures and Public Appointments Committee on 25 June 2008, 8 of those donations were registered as gifts. The Committee’s recommended sanction for breach of the Interests of Members of the Scottish Parliament Act 2006 was subsequently considered and rejected by the Parliament on 4 September 2008, the first time since the Parliament was established that a sanction recommended by the Standards committee has been rejected.

As a result of consideration of this complaint, the SPCB has changed the arrangements for the provision of legal advice to the Scottish Parliamentary Standards Commissioner. Henceforth, where the Scottish Parliamentary Standards Commissioner requires advice on a point of law he will first seek this from the Solicitor to the Scottish Parliament and, if a second opinion is required, this will be on the basis of a memorial agreed with the Solicitor to the Parliament.
