The meeting opened at 1.46 pm.
1. Subordinate legislation: Johann Lamont MSP (Deputy Minister for Justice) moved the following motion—
S2M-5210 That the Justice 2 Committee recommends that the draft Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Treatment of Office or Body as Specified Authority) (Scottish Legal Complaints Commission) Order 2006 be approved.
The motion was agreed to.
2. Subordinate legislation: Johann Lamont MSP (Deputy Minister for Justice) moved the following motion—
S2M-5209 That the Justice 2 Committee recommends that the draft Criminal Legal Aid (Scotland) (Prescribed Proceedings) Amendment Regulations 2006 be approved.
The motion was agreed to.
3. Subordinate legislation: Johann Lamont MSP (Deputy Minister for Justice) moved the following motion—
S2M-5208 That the Justice 2 Committee recommends that the draft Advice and Assistance (Assistance by Way of Representation) (Scotland) Amendment (No. 2) Regulations 2006 be approved.
The motion was agreed to.
4. Petition PE863: The Committee considered Petition PE863 by Bill Alexander which calls for the Scottish Parliament to urge the Scottish Executive to amend the Solicitors (Scotland) Act 1980. The Committee agreed to write to the Scottish Executive to emphasise the importance it placed on the commencement of sections 25 to 29 of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990 and to conclude consideration of the petition.
5. Petition PE893: The Committee considered Petition PE893 by Paul Macdonald which calls for the Scottish Parliament to oppose the introduction of any ban on the sale or possession of swords in Scotland which are used for legitimate historical, cultural, artistic, sporting, economic and religious purposes. The Committee agreed to note and to conclude consideration of the petition. The issues raised will be considered as part of the Committee’s Stage 1 report on the Custodial Sentences and Weapons (Scotland) Bill.
6. Tribunals, Courts and Enforcement Bill (UK Parliament legislation): The Committee considered the legislative consent memorandum lodged by Cathy Jamieson, Minister for Justice (LCM (S2) 10.1) and agreed to seek written and oral evidence.
7. Custodial Sentences and Weapons (Scotland) Bill (in private): The Committee considered an issues paper and agreed to consider a draft report, in private, at its next meeting.
